This federal criminal statute replaces and expands the older credit cards fraud and debit instrument fraud laws. Under federal law, the definition of “credit card” and “debit instrument” is extended to any “access device”, not just credit cards. In the past, thousands of individuals have been prosecuted under 18 U.S.C. §1029  for fraud involving debit cards, ATM cards and their PINS, credit card or debit card account numbers, cable boxes, long-distance access codes, and even cell phone billing hardware.

What is “Access Device”

An “Access device” is defined at 18 U.S.C. § 1029(e)(1) as any “card, plate, code, account number, electronic serial number, mobile identification number, personal identification number, or other telecommunications service, equipment, or instrument identifier, or other means of account access that can be used, alone or in conjunction with another access device, to obtain money, goods, services, or any other thing of value, or that can be used to initiate a transfer of funds….”

Many access device fraud prosecutions are based on the “counterfeit” or “unauthorized” access device” theories. A counterfeit access device means any access device that is counterfeit, altered, or forged.

For example, in one case, a NY court held a credit card application containing false or inflated information a counterfeit access device.

“Unauthorized access device” is any access device that is lost, stolen, expired, revoked, canceled, or obtained with intent to defraud.
